The dominant, individualistic understanding of autonomy that features in clinical practice and research is underpinned by the idea that people are, in their ideal form, independent, self-interested and rational gain-maximising decision-makers. In recent decades, this paradigm has been challenged from various disciplinary and intellectual directions. Proponents of ‘relational autonomy’ in particular have argued that people’s identities, needs, interests – and indeed autonomy – are always also shaped by their relations to others. Yet, despite the pronounced and nuanced critique directed at (...) an individualistic understanding of autonomy, this critique has had very little effect on ethical and legal instruments in clinical practice and research so far. This article investigates a high-profile and ongoing dilemma for healthcare professionals (HCPs), namely whether the existence of a (legal) duty of care to genetic relatives of a patient is a help or a hindrance in deciding what to do in cases where a patient’s genetic information may have relevance to the health of the patient’s family members. The English caseABC v St George’s Healthcare NHS Trust and othersconsidered if a duty of confidentiality owed to the patient and a putative duty (...) of care to the patient’s close relatives could coexist in this context. This article examines whether embracing the concept of coexisting duties could enable HCPs to respect duties in line with their clinical judgement, thereby providing legal support and clarity to professionals to allow them to provide the best possible genetics service to both the patient and their family. We argue that these dual duties, framed as a novel, composite duty to consider the interests of genetic relatives, could allow HCPs to exercise and act on their professional judgements about the relative value of information to family members, without fears of liability for negligence or breach of confidence. Spurred by a confluence of factors, most notably the decreasing cost of high-throughput technologies and advances in information technologies, a number of population research initiatives have emerged in recent years. These include large-scale, internationally collaborative genomic projects and biobanks, the latter of which can be defined as an organized collection of human biological material and associated data stored for one or more research purposes. Biobanks are a key emerging research infrastructure, and those established as prospective research resources comprising biospecimens and (...) data from many participants are viewed as particularly promising drivers of biomedical progress. While ethical norms for conducting academic research in the United Kingdom are relatively clear, there is little empirical understanding of how university research ethics committees (RECs) themselves operate and whether they are seen to operate well. In this article, we offer insights from a project focused on the Scottish university context. We deployed a three-sided qualitative approach: (i) document analysis; (ii) interviews with REC members, administrators, and managers; and (iii) direct observation of REC meetings. We found that RECs have diverse (...) operation and vary in terms of what members understand to be the remit of their REC and what should constitute the content of ethics review. Overall, though, most participants perceive university RECs as operating well. When asked what they consider to be areas for further improvement, most commented on: implementation of an online system; more experience with how to evaluate various kinds of research projects; best practice exchange and training opportunities; more accurate reflection of the REC role as part of the university’s workload allocation model; and greater recognition of the importance of research ethics governance in the university’s research environment, and, for the members themselves, their career advancement. Based on our findings and subsequent discussions during an end-of-project roundtable with stakeholders, we propose a model of collaboration that can address some of the identified areas that could benefit from further improvement. This model would facilitate a heightened awareness of the importance of supporting REC members in their own effort in assisting students and staff alike in undertaking as ethically robust research as possible. Life sciences research is increasingly international and data-intensive. Researchers work in multi-jurisdictional teams or formally established research consortia to exchange data and conduct research using computation of multiple sources and volumes of data at multiple sites and through multiple pathways. Despite the internationalization and data intensification of research, the same ethics review process as applies to single-site studies in one country tends to apply to multi-site studies in multiple countries. Because of the standard requirement for multi-jurisdictional or multi-site ethics review, (...) international research projects are subjected to multiple ethics reviews of the same research protocol. Consequently, the reviews may be redundant and resource-consuming, whilst the opinions delivered by ethics committees may be inconsistent both within and across jurisdictions. This article argues in general support of the sIRB rule, but also draws on recent empirical research to highlight several residual weaknesses in the US regulatory structure for research ethics review, and suggests ways in which these weaknesses might be addressed in future regulatory reforms to improve upon the sIRB rule.

Yet such a contrast fails to provide an adequate account of the full scope of either philosophy or psychoanalysis. On the one hand, philosophical inquiry is not wholly pre-empted by the question of reality; it may also extend into the realm of phantasy, as can be seen in Plato's effort to determine the epistemological value of eikasia or in Husserl's consideration of Phantasie as a basis of insight into essences. On the other hand, psychoanalysts are as concerned about reality as (...) they are about phantasy. Indeed, one of the key phrases of psychoanalytic therapy is "adaptation to reality." The reason for this concern with reality is clear: if phantasies are modifications or distortions of the real, it is imperative to discern what the character of reality is, especially since it is held out as the standard of a sound state of mental health. IMAGINING and remembering, two of the most frequent and fundamental acts of mind, have long been unwelcome guests in most of the many mansions of philosophy. When not simply ignored or over-looked, they have been considered only to be dismissed. This is above all true of imagination, as first becomes evident in Plato’s view that the art of making exact images tends to degenerate into the making of mere semblances. Kant, despite the importance he gives to imagination in the first (...) edition of The Critique of Pure Reason, nevertheless considers images to be lowly "monograms" that are unruly and thus untrustworthy. In more recent times, Sartre, who is nearly as ambivalent as Kant on the subject, has stressed imagination’s "essential poverty"—its character as "debased thought"—while Ryle, in covert counterpoint, has attempted to conceive imagining as parody and pretense: as mere make-believe. In this imaginative and comprehensive study, Edward Casey, one of the most incisive interpreters of the Continental philosophical tradition, offers a philosophical history of the evolving conceptualizations of place and space in Western thought. Not merely a presentation of the ideas of other philosophers, _The Fate of Place_ is acutely sensitive to silences, absences, and missed opportunities in the complex history of philosophical approaches to space and place. I BEGIN WITH A PUZZLE of sorts. Time is one; space is two—at least two. Time comes always already unified, one time. Thus we say “What time is it now?” and not “Which time is it now?” We do not ask, “What space is it?” Yet we might ask: “Which space are we in?”. Any supposed symmetry of time and space is skewed from the start. If time is self-consolidating—constantly gathering itself together in coherent units such as years or hours (...) or semesters or seasons— space is self-proliferating. Take, for example, the dimensionality of space. One dimension in space is represented by a point or a line, whose radically reduced format mocks the extensiveness of cosmic space. Two dimensions, as in a plane figure, also falls far short of our sense that space spreads out indefinitely far beyond the perceiving subject. Only with three dimensions do we begin to approach an adequation between the structure and the sense of space. For then the subject is surrounded by something sufficiently roomy in which to live and move. Indeed, as Aristotle, Kant, and Merleau-Ponty all remark, the three-dimensionality of space directly reflects our bodily state, that is, the fact that as upright beings three perpendicular planes implicitly meet and intersect in us. Even here, proliferation abounds: our bilateral symmetry means that each dimension is doubled: one vertical plane bifurcates into “up” and “down,” the other vertical plane into “front” and “back,” and the horizontal plane into “right” and “left.” Thus subject-centered space is triple, only to be redoubled. Further, if we think of spatiality not as body-based but as locatory—as determined by landmarks and other locales in the environment—the proliferation is more striking still. There are the four cardinal directions, which themselves split easily into the thirty two points of a compass. Nor need we be so arithmetically well-rounded. Even apart from fancy mathematical models of n –dimensional space, and recent technological instantiations of virtual space, there is no end to the number or ways in which we can be oriented in space—in accordance with what Deleuze and Guattari call “the variability, the polyvocity of directions” by which we can move in any given spatial scene. Beyond direction, however, is place. Heidegger remarks that “space has been split up into places.” The fact is that we continually find ourselves immersed in a multiplex spatial network whose nodal points are supplied by particular places. Edward S. Casey invites us to rethink our emotions as fundamentally emerging from outside and around the self, redirecting our attention from the subjective sources of emotion to what reaches us from outside the domain of the subject.

What is bound to mislead us is the dichotomist assumption that keeping in mind must be either an entirely active or an utterly passive affair. This assumption has plagued theories of memory as of other mental activities. On the activist model, keeping in mind would be a creating or recreating in mind of what is either a mere mirage to begin with or a set of stultified sensations. Much as God in the seventeenth century was sometimes thought to operate by (...) continual creation, so the mind was given the same lofty powers in the Romantic thought that represented a reaction to much of what the seventeenth century stood for. But the activist model is by no means limited to the Romantic idealists or Natur-philosophen. It reappears in more than one phase of phenomenology, and it informs the sober theorizing of Bartlett and Piaget on the nature of remembering. On the passivist model, on the other hand, the mind is mute and unconfigurating. It takes in but does not give back other than what it takes in. It is a recording mechanism only. Something like this view is at work in empiricist theories of memory, considered as restricted to the contents of Humean "impressions" and arranged according to their order and position in time; it continues in Kant's notion of "reproductive imagination" as operating by association alone; and it is found flourishing today in psychological accounts of what is revealingly called "human associative memory.". In "mind-Body identity, Privacy and categories" richard rorty set forth a new form of the identity theory of the mind, (called the 'disappearance' version) in which he suggested that instead of identifying sensations with neural events, Sensations might be eliminated. Using an illustration of rorty's I show that 'pain' cannot come to refer to a brain process for neural events are neither pleasant nor unpleasant. For 'pain' to refer to something unpleasant, We would have to give 'brain process' the connotation (...) of unpleasantness. But to do this would be to identify the brain process with the sensation of pain--I.E., To return to the older identity theory. (shrink)

One of the foundational texts of interpersonal psychoanalysis, _Prelogical Experience_ is a pioneering attempt to elaborate an interpersonal theory of personality that encompasses the nonpropositional, nonverbal dimension of human experience. Prelogical processes, the authors hold, cannot be consigned to infancy; rather they shape experience throughout life and are especially salient in relation to dreams, emotion, perception, and the arts. Of special note is Tauber and Green's elaboration of the clinical situation that grows out of an appreciation of prelogical experience. In (...) a striking anticipation of contemporary thinking, they approach patient-therapist interaction in terms of the continuous exchange of "presentational data" by patient and analyst. These data enable patient and therapist alike to "know" more about the other than can ever be expressed in propositional terms. This perspective assigns an important role to what Piaget would term "the cognitive unconscious" in the clinical process. It likewise sustains a view of the countertransference - which includes the analyst's own dreams - as a vital source of presentational data about the patient. As Donnel Stern notes in his Introduction, these and other insights "amount to a surprisingly contemporary description of psychoanalytic treatment.". (shrink)
